1. Acceptance of Terms

Welcome to Therapovo! These Terms of Service ("Terms") constitute a legally binding agreement between you and Therapovo ("we," "our," "us") governing your access to and use of our website, mobile applications, and related services (collectively, the "Platform").

By creating an account, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Platform.

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms. We will notify you of significant changes via email or Platform notification.

2. User Eligibility

To use Therapovo, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding agreements
• Not be prohibited from using the Platform under applicable laws
• Provide accurate and complete registration information

If you are using the Platform on behalf of a minor (with appropriate parental consent for wellness services), you accept these Terms on their behalf and are responsible for their use of the Platform.

3. User Accounts & Registration

When you create an account:

• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your login credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• You may not share your account or let others use your login credentials

We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for extended periods, or are used for fraudulent purposes.

4. User Responsibilities

As a user, you agree to:

• Use the Platform only for lawful purposes and in accordance with these Terms
• Provide truthful information when booking sessions and communicating with practitioners
• Attend booked sessions on time or cancel within the allowed timeframe
• Treat practitioners, staff, and other users with respect and professionalism
• Pay for services as agreed and honor booking commitments
• Not misuse the Platform or interfere with its normal operation
• Report any issues, concerns, or violations to our support team

5. Acceptable Use Policy

You agree NOT to:

• Use the Platform for any illegal or unauthorized purpose
• Harass, abuse, threaten, or intimidate other users or practitioners
• Post or transmit harmful, offensive, or inappropriate content
• Impersonate any person or entity or misrepresent your affiliation
• Collect or harvest user information without consent
• Upload malware, viruses, or any destructive code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated systems (bots, scrapers) to access the Platform
• Interfere with or disrupt the Platform's infrastructure
• Circumvent any security measures or access restrictions
• Use the Platform to promote competing services

Violation of this policy may result in immediate account termination and legal action where appropriate.

6. Intellectual Property Rights

The Platform and its original content, features, and functionality are owned by Therapovo and are protected by intellectual property laws. This includes:

• Trademarks, logos, and brand elements
• Website design, layout, and user interface
• Software, code, and technical implementations
• Original content, articles, and educational materials

You may not copy, modify, distribute, sell, or lease any part of the Platform without our written permission. You retain ownership of content you create (like reviews), but grant us a license to use it on the Platform.

7. Practitioner & Wellness Center Conduct

Important Disclaimer: Therapovo is a marketplace platform connecting users with independent practitioners and wellness centers. We are NOT a healthcare provider, and practitioners/centers listed on our Platform are independent professionals, not Therapovo employees.

While we verify practitioner credentials through our 4-tier process, practitioners are independently responsible for:

• The quality and appropriateness of their services
• Maintaining valid licenses and certifications
• Following professional ethical guidelines
• Providing accurate information about their qualifications
• Handling client information confidentially

We encourage users to report any concerns about practitioner conduct. We investigate all reports and may remove practitioners who violate our standards.

8. Booking & Payment Terms

Bookings

• Bookings are confirmed upon successful payment
• You'll receive confirmation via email with session details
• It's your responsibility to attend at the scheduled time
• Session packages are valid for the specified period (typically 3-6 months)

Payments

• All prices are displayed in Indian Rupees (INR) and include applicable taxes
• Payments are processed securely through Razorpay
• We accept major credit/debit cards, UPI, net banking, and wallets
• You agree to pay all fees associated with your bookings
• Pricing is set by individual practitioners and may vary

9. Cancellations & Refunds

Cancellation Policy

• Free cancellation: Cancel more than 24 hours before your session for a full refund
• Late cancellation: Cancellations within 24 hours may incur a 50% fee
• No-shows: Failing to attend without canceling is not eligible for refund
• Practitioner cancellation: If a practitioner cancels, you receive a full refund automatically

Refund Process

• Refunds are processed to your original payment method
• Processing time: 5-7 business days (1-3 days for UPI)
• You'll receive email confirmation when refund is initiated
• For disputes, contact support within 48 hours of the session

10. Disclaimers & Limitations of Liability

Platform Disclaimer: Therapovo is a technology platform that connects users with wellness practitioners. We do not provide medical advice, diagnosis, or treatment. The Platform is not a substitute for professional medical care.

Service Disclaimer: We provide the Platform "as is" and "as available" without warranties of any kind. We do not guarantee that the Platform will be uninterrupted, secure, or error-free.

Practitioner Disclaimer: We are not responsible for the actions, advice, or conduct of practitioners listed on our Platform. Any interaction with practitioners is at your own risk.

Limitation of Liability: To the maximum extent permitted by law, Therapovo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

Maximum Liability: Our total liability for any claim arising from your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Therapovo, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Your content or information submitted to the Platform
• Any disputes between you and practitioners

12. Dispute Resolution

We want to resolve disputes quickly and fairly. If you have a concern:

1. Contact Support: Reach out to support@therapovo.com first. Most issues can be resolved informally.
2. Formal Complaint: If unresolved, submit a formal written complaint. We'll respond within 15 business days.
3. Mediation: If still unresolved, we agree to attempt mediation before litigation.
4. Arbitration: Disputes that cannot be resolved through mediation will be settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

You agree that any dispute will be resolved on an individual basis, not as a class action or representative proceeding.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any legal proceedings arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
